Buendia, 24, is an ex-marine accused of shooting a Hillsborough County deputy, when she responded to a domestic violence call at his residence. The deputy was shot twice in her leg and once in her shoulder. She was recently released from the hospital and is expected to recover from her injuries.

Buendia served three tours of duty as a United States Marine in Iraq and Afghanistan. Friends and family have said that he suffers from post-traumatic stress disorder. This was recently confirmed by his attorney, Mark J. O'Brien.

"So the legal question that remains...is whether Matthew Buendia, a decorated soldier yet barely a man, without a blemish on his record, intentionally attempted to kill his fellow American hero on Sept. 30, 2011," said O'Brien as quoted on Tampa Bay Online. "We believe that while Buendia left behind the horrors of war, the horrors of war never left him," O'Brien expounded.

"We believe that a man who served three tours of combat, killing the enemy as ordered, all the while trying not to be killed -- in order to protect our freedom -- would never knowingly attempt to take the life of another person trained to do the same," O'Brien continued.

O'Brien said that troops returning from fighting deserve treatment for their hidden mental health defects just as much as treatment for their visible physical injuries. "Our troops deserve more from our government and us as a community when they return from fighting in foreign lands," he said.

According to O'Brien whether Buendia is found innocent or guilty, there will be no winners. "...[Buendia] is not a deranged defendant with criminal intent, but instead a very sick soldier who desperately needs mental health treatment," O'Brien said. "Where Matthew Buendia ends up at the conclusion of this case will say a lot about who we are as a community," O'Brien concluded.
